Robert Rastorp

Robert, a Member of the Society of Trusts and Estates Practitioners (STEP),  has years of experience as an Estate Litigation lawyer. Importantly, he is also a seasoned litigation lawyer representing clients before numerous tribunals and at all levels of court right up to the Court of Appeal for Ontario.

Professional Background with an Ivy-League College Education

A political science/international relations graduate with a B.A. from Queen’s University and an M.A. from Columbia University, Robert completed his J.D. at the University of Toronto, Faculty of Law, where he attained “A (Honours)” Standing and was awarded the Leonard Feigman, Q.C. Prize in Evidence and the Norman Levy Prize in Jurisprudence. He went on to obtain an LL.M. in Law and Economics at that university under the supervision of Professor Michael Trebilcock, and received a Canada Graduate Scholarship from the Social Sciences and Humanities Research Council of Canada. Robert was called to the Bar of Ontario in 2008.

Representative work

Cross-border Mareva Injunctions: Robert has handled cross-border Mareva injunctions in the context of an offshore estate worth over $130 million, and successfully upheld a stay of an adverse ruling at the lower court concerning that injunction at the Court of Appeal for Ontario. Rob has also argued a Mareva Injunction supporting a US-based lawsuit for more than $10 million in the Ontario courts.

Cross-border Estates: Robert has acted along with team members from Rogerson Law Group in a complex cross-border estate litigation which also triggered an ancillary commercial litigation dispute in Ontario for over $10 million.  A successful settlement was obtained for the client.

Domestic Estates: Robert assisted a beneficiary under an estate who had been denied information about, and access to, the accounts of the estate by the executor, in obtaining full disclosure from the executor and compensation from the executor for misappropriation of funds, as well as denial of executor’s compensation fees to them.

On another matter, Robert is assisting a client who acts as executor for an estate against beneficiaries who have initiated a meritless will challenge, and groundless personal accusations against her personal character and administration of the estate.
